The Five Loyalty Program
General T&C 
 

Eligibility: 
1.1. The Program is open to individuals who are at least 18 years old. 
 

Program Benefits:  
2.1. The Program offers a cash back reward of 5% on all eligible spending during an eligible stay for Members of The Five Loyalty Program (‘Members’).
2.2. ‘Eligible spending’ includes charges for accommodation, food and beverages, spa treatments on their net amount. The minimum spending amount to be eligible must be more than 10 CHF (net).  
2.3. Cash back rewards are calculated based on the eligible spending made during the eligible stay and will be credited to the Member's loyalty account within a reasonable time frame after the eligible stay has been completed. 
2.4 'Eligible stay' stands for all the reservations that have been made directly through the Hotel reservation/booking channels. 
2.5. Reservations made through a third party (including, but not limited to Booking.com, Expedia, Voucher, Travel agencies) or in any way other than directly through a Hotel reservation/booking channel are not deemed eligible and will not be credited to the Member’s Loyalty Account. 
 

Membership: 
3.1. Membership in The Five Loyalty Program is voluntary and entails no payment obligation. 
3.2. To become a member, individuals must enroll to The Five Loyalty Program through the Hotel's designated enrollment channels. 
3.3. Members must provide accurate and complete information during the enrollment process. The Hotel reserves the right to verify the information provided and may decline or terminate membership if false or misleading information is discovered. 
3.4. Membership is non-transferable and can only be used by the enrolled member. 
3.5. The membership expires 4 years after the last booking.

Cash Back Rewards: 
4.1. Cash back rewards can be redeemed by the member for future stays at the Grand Hotel des Bains Kempinski. 
4.2. Cash back rewards cannot be exchanged for cash or any other form of compensation. 
4.3. Cash back rewards expire after 16 months from the check out date. 
4.4.  Cash back rewards cannot be credited retroactively. To be eligible for cash back, the membership must be active at the time of booking. This means that cash back cannot be applied after check-out, if the membership was created post-check-out, or if the membership number was not provided during the stay.
 

Termination and Modification: 
5.1. The Hotel reserves the right to terminate or modify the Program at any time, with or without notice. 
5.2. In the event of termination or modification, the Hotel will make reasonable efforts to notify members in advance. 
5.3. Termination or modification of the Program will not entitle members to any compensation or refund for unused cash back rewards.
5.4. Members may terminate their membership at any time with immediate effect by notifying the Hotel. Cash back rewards are only valid while the membership is active and cannot be used once the membership is terminated.
5.5. After termination of the Membership, the Hotel will no longer use the personal data of Members for the Loyalty Program. Details about the deletion, collection and use of personal data are further described in the Five Loyalty Privacy Policy.
 

Privacy and Data Protection: 
6.1. By enrolling for The Five Loyalty Program, members consent to the collection,  processing and use of personal data. This consent can be withdrawn at any time. In this case, the membership in The Five Loyalty Program is terminated automatically with immediate effect.
The Hotel will collect and process personal data provided by members in accordance with applicable data protection laws and regulations, especially with the Swiss Federal Act on Data Protection (nFADP)
6.2. Details on the collection, use und processing of personal data can be found in The Five Loyalty Privacy Policy. 
 

Governing Law: 
7.1. These terms and conditions shall be governed by and construed in accordance with the substantive laws of Switzerland. Place of performance and place for payment is agreed to be at the  location of the Hotel in St. Moritz, Switzerland. 
7.2. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the competent courts in St. Moritz, Graubünden, Switzerland, if and insofar as permissible under the applicable law.
