KEMPINSKI DISCOVERY B2B Incentive Programme Terms & Conditions
The KEMPINSKI DISCOVERY B2B Incentive Programme (“Programme”) is a loyalty initiative derived from the GHA DISCOVERY Programme and managed by Kempinski Hotel Group. Kempinski Hotel Group (“Kempinski”) refers to Kempinski Hotels S.A., its subsidiaries and affiliates, as well as the Kempinski operating hotels that participate in the Programme (“Participating Hotels”).
The KEMPINSKI DISCOVERY B2B Incentive Programme Terms & Conditions (“Terms & Conditions”) shall govern the KEMPINSKI DISCOVERY B2B Incentive Programme. The participation in the Programme implies the express and unreserved acceptance of these Terms & Conditions. Kempinski reserves the right, at its sole discretion, to modify, suspend, or cancel the Programme, and to change, modify, add, or remove any of these Terms & Conditions at any time. Unless otherwise indicated, any changes to the Terms & Conditions will become effective immediately upon the posting of the changes to the Kempinski website.
The Programme and its benefits are offered at the sole discretion of Kempinski. If Kempinski terminates the Programme, Kempinski shall have no obligation to offer a replacement programme. Programme benefits are subject to the absolute discretion of Kempinski and the Participating Hotels, determining whether and how rewards are allocated.
1. Eligibility
The Programme is exclusively available to individuals who are responsible for organising meetings, conferences or professional events on behalf of a firm, association, events agencies or venue finders that employ them (“Meeting Organiser”).
2. GHA DISCOVERY Programme

The KEMPINSKI DISCOVERY B2B Incentive Programme Terms & Conditions shall take priority in the event of any conflict between these two terms & conditions.
3. KEMPINSKI DISCOVERY B2B Incentive Programme
The Programme is exclusively available for a professional event with a minimum of ten (10) participants or ten (10) rooms (“Qualifying Event”).
To participate in the KEMPINSKI DISCOVERY B2B Incentive Programme, Meeting Organisers must be members of the KEMPINSKI DISCOVERY Programme. Benefits of the KEMPINSKI DISCOVERY B2B Incentive Programme can be applied to the Meeting Organiser only when their KEMPINSKI DISCOVERY Programme membership number is clearly stiputelated in the contract governing the Qualifying Event entered into with the Participating Hotel. Should the Meeting Organiser’s KEMPINSKI DISCOVERY Programme membership number not be stipulated in the contract, the Meeting Organiser is ineligible to claim Programme benefits.

5. Earning DISCOVERY Dollars (D$)
A Meeting Organiser will earn DISCOVERY Dollars (D$) equivalent to 1% of their total net eligible spend, which is outlined in the contract governing the Qualifying Event (“Event Purchase”).
Costs associated with event room revenue, internal pre-booked Food & Beverage, internal banqueting, and meeting room rentals typically constitute the Event Purchase. Taxes and gratuities are excluded from the Event Purchase. External 3rd party services - catering, banqueting, decoration, technical supplier for audio/visual/stage etc., are not eligible.
D$ will be awarded to the KEMPINSKI DISCOVERY Programme membership account of the Meeting Organiser within two (2) weeks from the date of full payment of the Qualifying Event invoice.
The D$ received by the Meeting Organiser is intended for individual travel use only. D$ expires twelve (12) months from the date of credit. The D$ awarded within the KEMPINSKI DISCOVERY B2B Incentive Programme operates independently of the Meeting Organiser’s KEMPINSKI DISCOVERY Programme tier-based expiry date.
The Programme is only for Qualifying Event booking made directly with a Participating Hotel.
The Participating Hotels may increase the D$ on a promotional basis as a gesture of goodwill. It is at the absolute discretion of Kempinski and the Participating Hotels to decide whether to award the D$ and the amount of D$ that a Meeting Organiser will earn.

6. No Show and Cancellation
No D$ will be awarded for "no show" situations or Qualifying Event bookings that are cancelled.

Kempinski reserves the right, at any time in its sole discretion and without any liability to the Meeting Organiser, to (a) modify, suspend, void or cancel all or a portion of the D$; and (b) modify, suspend, void or cancel the redemption of D$, for reasons that include, but are not limited to:
Kempinski may also take any appropriate legal or administrative action, including, without limitation, prosecution, if any of the above occurs.
9. Tax Liability
The benefits and rewards offered in the KEMPINSKI DISCOVERY B2B Incentive Programme may be subject to income or other taxes or duties. Such taxes and all disclosures related thereto are the absolute responsibility of the Meeting Organiser.
10. Subject to Applicable Law
Participation in this Programme and the collection and redemption of the benefits offered are subject to and may be void where prohibited or restricted by applicable laws, rules or regulations.
11. Disclaimer
By participating in the KEMPINSKI DISCOVERY B2B Incentive Programme, Meeting Organisers expressly acknowledge and agree that Kempinski provides this Programme, these and other materials, and other services and products “as-is” and, to the fullest extent permitted by applicable law, expressly disclaims any warranties of any kind, express, implied or statutory, including, but not limited to, warranties of merchantability, fitness for a particular purpose, design, accuracy, capability, sufficiency, suitability, capacity, completeness or availability. Meeting Organisers also agree that Kempinski does not represent, warrant, or guarantee that the KEMPINSKI DISCOVERY B2B Incentive Programme or any such other products and services will be uninterrupted, without omissions or error, or that defects will be corrected or changes implemented.
12. Limitation of Liability
Under no circumstances, including, but not limited to, negligence, shall Kempinski be liable for any direct, indirect, incidental, special or consequential damages arising out of the KEMPINSKI DISCOVERY B2B Incentive Programme, the use of D$ or any such other products and services, even if Kempinski or a Kempinski authorised representative has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to certain Meeting Organisers. Meeting Organisers hereby waive any and all rights to bring any claim or action related to such matters in any forum beyond two (2) years after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
13. Indemnification:
By participating in this Programme, each Meeting Organiser agrees to indemnify, release and hold harmless Kempinski, its advertising and promotion agencies, and any of their parents, subsidiaries and affiliates, and their respective directors, officers, employees and agents, from any liability, costs, damages and fees (including attorney’s fees) arising out of any use or misuse of this Programme by that Meeting Organiser.

15. Governing law and competent jurisdiction
These Terms & Conditions, and the Meeting Organiser’s participation in this Programme, shall be governed by the laws of Switzerland without regard to its conflict of laws rules. Meeting Organisers agree to submit to the exclusive jurisdiction of the courts located in Geneva, Switzerland, to resolve any legal matter arising out of or in connection with these Terms & Conditions and this Programme.
16. Class claims
To the extent permitted by law, Meeting Organisers agree not to file a class action or class arbitration against Kempinski or participate in a class action or class arbitration against Kempinski for any claim arising out of or in connection with these Terms & Conditions and this Programme.
17. Waiver
A failure or delay by Kempinski to exercise any right or remedy provided under these Terms & Conditions or by law shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy. No single or partial exercise of any right or remedy provided under these Terms & Conditions or by law shall prevent or restrict the further exercise of that or any other right or remedy.
18. Severability
If any part of these Terms & Conditions should be determined invalid by reason of the relevant laws, it shall be removed without affecting the rest of the Terms & Conditions. The remaining of the Terms & Conditions will continue to be valid and enforceable.
19. Interpretation
All interpretations of these Terms & Conditions shall be at the absolute discretion of Kempinski.
